TERMS AND CONDITIONS FOR ALL CONSULTANCY WORK & CONTRACTS
GENERAL
These Terms and Conditions apply to all Fee-Paying and Consultancy work as undertaken by TFT Woodexperts Limited (“Woodexperts”). This work will include – but is not necessarily limited to – contracted training courses, Expert Witness reports (including SJE Reports), site investigations and quality assurance assessments.
FEES
Fees are normally charged on a daily basis and, where appropriate, divided into half-day increments; with all reasonable expenses (travel, accommodation, subsistence, etc) in addition. However, in exceptional cases, an hourly rate may be quoted; and/or an all-inclusive total may be negotiated by agreement.
Woodexperts' daily fee rates will vary, depending upon the nature of the work to be carried out. Fee rates will be quoted for each individual job on its merits; and they are subject annual review.
Discounts may be available from the usual daily rate; especially where there is repeat business from the same client, over a known or predicted timescale.
PAYMENT OF INVOICES
Payment of fees in full is usually required no later than 30 days from the date of issue of the relevant fee invoice. On occasion – depending upon the work – a shorter time-scale will be quoted.
For one-off consultancy jobs, fees will be invoiced at the same time as the report is issued: except in the case of Single Joint Expert Reports, where the invoices will be issued to each party as soon as the inspection has taken place: and the final Report will only be released (simultaneously to both/all parties) when both/all invoices are paid in full, and not before.
In respect of training courses, fees may be invoiced to the client in full or in part at the commencement of the course.
All other work may be invoiced at a timescale to suit Woodexperts.
CANCELLATION CHARGES
In the event of any agreed and pre-booked (diaried) consultancy work being cancelled, Woodexperts then reserves the right to charge the client a cancellation fee of up to 50% of the agreed sum, depending upon the lateness of the notification of any cancellation.
Where agreed and pre-booked consultancy work (of any kind) is cancelled at 5 working days’ notice or less, then 50% of those agreed fees shall be chargeable to the client.
CONFIDENTIALITY
Woodexperts will respect client confidentiality in all matters. No reports, or minutes of any discussions, will be made available to any third party without the express agreement of TFT’s client, unless so ordered by the Courts.
GDPR
In order to comply with the GDPR, as introduced on 25th May 2018, TFT Woodexperts Limited declare that we will never disclose any of our client's details to any third party, without express written agreement. We do not keep personal details on file - only email and/or postal names and addresses: but we do not send out Newsletters, email fliers, etc.
Any details of clients that we do hold - or may hold in future - are used solely for business matters and are securely stored; and all electronic records, etc are fully password protected. If you wish us not to retain your details, then please email us to that effect. (However, we do reserve the right, as permitted under the GDPR, to retain clients' address details for legitimate business reasons; such as invoicing, etc.)
